No Smoking Policy

The smoking of prohibited tobacco products will NOT be permitted on Tallahassee Housing Authority (THA) properties. This includes, scattered site homes, public buildings, and grounds in accordance with the following guidelines. This ban includes cigarettes, e-cigarettes, cigars, pipes and hookah (water pipes).
All terms and provisions appearing in this Smoking Policy are made a part of the THA Dwelling Lease in force for all THA properties.

Effective June 1, 2018 all current and new residents, guest, all employees, vendors, and visitors in and/or on THA property will be prohibited from smoking inside the public buildings and units, common areas, grounds and streets of Tallahassee Housing Authority properties. Any resident, including the members of their household, guests, or visitors will be considered in violation of the lease if found smoking anywhere on THA property.

Four (4) violations will be considered to be a repeated violation of the material terms of the lease and will be cause for eviction. The “No Smoking Policy” is anticipated to have varying levels of resident compliance and will create additional responsibility for property management staff to enforce. The following is an outline of our enforcement plan:

1. First violation--the resident will be issued a letter that they are in violation of the lease and include a warning that a $250.00 cleaning charge for violation of the policy. (Any cigarette butts not properly disposed in front and rear of the unit may also be cause for a cleaning service charge). Smoking cessation literature will also be given.

2. Second violation--will receive a second warning notice, smoking cessation material and an offer of help completing an on-line Tobacco Free Florida referral form.

3. Third violation--will result in a third warning notice from management documenting smoking incidences on record.

4. Fourth violation--will result in a “Notice to Cure Else Proposed Notice of Lease Termination Warning”. Any subsequent violation will result in a Thirty (30) Day Notice to Vacate with grievance hearings.

No smoking signs will be posted both outside and inside the common areas of THA property. Residents will be responsible to inform all their guests and visitors that their apartment is smoke free and that their housing may be affected by violators.

If the smell of smoke is reported, THA will seek the source of the smoke and appropriate action will be taken. Residents are encouraged to promptly give management a written statement of any incident where tobacco smoke is migrating into the Resident's unit from sources outside of the Resident's unit.

Upon adoption of this policy, all residents presently living in Tallahassee Housing Authority units will be given a copy of the policy. After review both incoming and current residents will be required to sign the Smoke Free Lease Addendum. A copy will be retained in the tenant file.

Failure to comply with the terms of this Addendum may be cause for lease enforcement action, including eviction.
